These Terms & Conditions ("Terms") govern your access to and use of the MoleMap mobile application, website pages, and related services (collectively, the "Service"). By downloading, accessing, creating an account, purchasing a subscription or credit pack, or otherwise using MoleMap, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 16 years old to use MoleMap. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian.
To access certain features, you may need to create an account. You agree to provide accurate, complete, and up-to-date information and to keep your login credentials secure. You are responsible for all activity that occurs under your account. If you believe your account has been accessed without authorization, contact us promptly at contact@merced.ro.
MoleMap is a skin health monitoring application that helps users photograph, organize, compare, and monitor moles and other skin lesions over time. The Service may include AI-powered analysis, risk indicators, historical comparisons, reminders, profile tools, subscription features, and one-time credit-based features.
We may update, improve, suspend, or discontinue parts of the Service from time to time, including introducing new features or changing existing functionality.
IMPORTANT: MoleMap is not a medical device, is not a medical diagnostic tool, and does not provide medical advice, diagnosis, treatment, prevention, or emergency medical services.
The Service, including any AI-generated output, score, risk indicator, comparison, reminder, suggestion, or recommendation, is provided only for personal tracking, informational use, and educational self-assessment. MoleMap is intended to help you photograph, organize, and observe visible changes in moles or skin lesions over time. It must not be used to diagnose skin cancer, melanoma, or any other disease or medical condition.
MoleMap results may be incomplete, inaccurate, delayed, or misleading. You must not rely on MoleMap as a substitute for consultation with a qualified doctor, dermatologist, or other licensed healthcare professional. You should always seek professional medical advice for questions about skin changes, suspicious lesions, or urgent symptoms. Do not ignore, avoid, or delay medical care because of anything shown or not shown by MoleMap. The Service is not designed for emergency use.
MoleMap may offer recurring subscriptions and one-time credit purchases. Current offers may include, for example:
* "Unlimited" is subject to reasonable and fair use limits, currently up to 1,500 analyses and comparisons per year unless a different limit is clearly displayed in the Service.
Subscription features, credit allowances, prices, taxes, billing periods, and commercial offers may change from time to time. Any such changes will apply as permitted by applicable law and by the terms of the relevant billing platform or payment provider.
Recurring subscriptions renew automatically unless canceled before the renewal deadline shown in the Service or by the payment platform used for purchase. By purchasing a recurring subscription, you authorize the applicable payment provider to charge your selected payment method for the initial subscription period and each renewal period until cancellation.
If you cancel a subscription, the cancellation takes effect at the end of the current paid billing period. You will retain access to the subscription benefits until that period expires, and your subscription will not renew after that point.
If a charge cannot be completed, we may suspend or limit access to paid features until payment is successfully processed.
Except where required by applicable law, recurring subscription charges, including Weekly, Monthly, and Yearly plans, are non-refundable once the applicable billing period has started.
You may cancel your subscription at any time, but cancellation does not entitle you to a prorated refund for the unused portion of the current billing period. Your access will continue until the end of the billing period already paid for.
Except where required by applicable law, we do not provide prorated refunds, partial refunds, or service credits for unused subscription time.
One-time credit purchases are also generally non-refundable once purchased, except where required by applicable law or where a refund is approved under the exceptional circumstances listed below.

If you believe you were charged in error, contact us at contact@merced.ro and include the email address used for your account together with relevant payment details so we can investigate.
Where the Service uses analysis credits, those credits are personal to your account, non-transferable, non-exchangeable, and have no cash value unless otherwise required by law. Credits may only be used within the Service for eligible features. We may correct credit balances if a billing, technical, or fraud issue is identified.
You retain ownership of the photos, images, and other content you upload to MoleMap ("User Content"). However, by uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and use that content solely as needed to operate, maintain, secure, improve, and provide the Service to you, including generating AI analysis and comparison results.
You represent and warrant that you have the necessary rights and permissions to upload the User Content you submit and that doing so does not violate the rights of any third party or any applicable law.
You agree not to misuse the Service. In particular, you must not:
The Service may rely on automated systems and third-party providers, including AI-based tools, to analyze images and generate outputs. These systems may produce incomplete, inaccurate, delayed, or inappropriate results. You acknowledge that AI analysis is probabilistic and may not identify all risks or may flag benign conditions incorrectly.
We do not guarantee uninterrupted availability of the Service, error-free operation, or that all analyses, comparisons, reminders, or stored records will always be available without delay.
The Service, including its software, design, branding, interface, text, graphics, databases, and underlying technology, is owned by or licensed to MoleMap and is protected by applicable intellectual property laws. Except for the limited right to use the Service in accordance with these Terms, no rights are granted to you.
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store, and share personal data, including health-related information and payment-related metadata. By using MoleMap, you acknowledge that your information will be processed as described in that policy.
We may suspend, restrict, or terminate your access to all or part of the Service if we reasonably believe that you have violated these Terms, created risk for us or other users, engaged in fraud or abuse, or used the Service unlawfully. We may also discontinue the Service or certain features at any time, subject to applicable law.
You may stop using the Service at any time. If you wish to delete your account, please follow the account deletion process available here: https://www.merced.ro/molemap/delete-account.html.
Nothing in these Terms excludes, restricts, or limits any rights you may have under mandatory consumer protection laws that apply in your country of residence. If applicable law grants you rights that are more favorable than these Terms, those legal rights will prevail to that extent.
If you purchase digital services that begin immediately after purchase, you acknowledge that the Service may be made available without delay. To the extent permitted by applicable law, your right of withdrawal or cancellation for immediately supplied digital content or digital services may be reduced or lost once performance of the Service has begun.
Some purchases may also be subject to additional rules, refund mechanisms, or billing procedures imposed by the relevant app store, platform, or payment provider.
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. We make no warranties or representations, express or implied, regarding merchantability, fitness for a particular purpose, availability, accuracy, reliability, or non-infringement.
To the maximum extent permitted by law, MoleMap will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, health-related decisions, or other intangible losses arising out of or related to your use of, or inability to use, the Service.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of Romania, except to the extent that mandatory consumer protection laws in your country of residence require otherwise.
If you have a concern, complaint, or dispute relating to the Service, we encourage you to contact us first at contact@merced.ro so we can try to resolve the issue informally and in good faith.
Unless mandatory law provides otherwise, any dispute arising out of or relating to these Terms or your use of the Service will be subject to the competent courts of Romania. If you qualify as a consumer under applicable law, nothing in this section prevents you from relying on any mandatory rights you may have to bring claims before the courts that are competent in your place of residence.
We may modify these Terms from time to time. If we make material changes, we may provide notice through the Service, on our website, or by other reasonable means. The updated Terms will become effective when posted unless otherwise stated. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the revised Terms.
